1. Scope
These General Terms and Conditions (GTC) apply to all orders, deliveries, and services between Langwieser Performance GmbH, registered in Perg, Austria (“Seller”), and the customer (“Customer”) via the online shop www.langwieser-performance.com. Customers may be consumers (B2C) or businesses (B2B).
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer. By placing an order, the customer submits a binding purchase offer. The contract is concluded through express acceptance or by dispatch of the goods.
3. Prices and Payment Terms
All prices are in euros, excluding shipping costs and – unless otherwise stated – including VAT. For deliveries outside the EU, additional duties, taxes, or fees may apply and are borne by the customer. Payment methods are shown during checkout. Shipping occurs only after full payment.
4. Delivery and Shipping
Shipping is worldwide to the address specified by the customer. Delivery times and costs are listed in the shop. Partial deliveries are allowed if reasonable.
Transport damage: The customer must inspect goods upon receipt. Visible damage must be reported in writing within 48 hours (with photos and damage report). Hidden damage must be reported within 5 working days. Late reports may void claims.
5. Right of Withdrawal (B2C Only)
Consumers have 14 days to withdraw from the contract without giving a reason, starting from the day the goods are received. Timely dispatch of the notice is sufficient.
Exclusions:
– Goods made to customer specifications or vehicle-programmed items
– Installed, used, or activated items
– Electronic components and control units
Return shipping costs are borne by the customer.

6. Returns and Packaging
Returns must be complete, unused, and in undamaged original packaging. For electronic or oil-containing parts, the original packaging protects the product and resale value. If damaged, dirty (e.g. oily), or unusable, we may deduct an amount based on the impairment.
7. B2B Returns
Returns for business customers are excluded, even for unused or originally packaged items.
8. Exchange Parts / Core Returns
Some items are sold on an exchange basis. No deposit is charged in advance. If the old part is not returned within the stated period, a replacement deposit may be charged. Returns must be complete and reusable.
9. Warranty Conditions
Warranty duration is stated in the product description. A warranty applies only if:
– Installed by a qualified workshop per manufacturer instructions
– Proper gearbox calibration (basic settings) was done
– Oil type, volume, and installation notes were followed
– The part was not opened or modified
Warranty covers only the supplied part, not:
– Installation/removal costs
– Material or labor costs
– Diagnostics, transport, or storage
– Consequential damage
Required for claims: defect report, diagnostic logs before/after, proof of proper installation.
Tuning check: If software manipulation (e.g. chiptuning) is detected, all warranty claims are void.
10. Statutory Warranty
B2C: 24 months from receipt, burden of proof shifts to customer after 6 months.
B2B: 12 months from delivery. Customer must inspect goods and report defects immediately (§377 UGB). Unreported defects = accepted goods.
Exclusions: improper installation, misuse, wear, tuning, or modification.
11. Retention of Title
Goods remain property of Langwieser Performance GmbH until fully paid.
12. Liability
Liability applies only to damages caused by gross negligence or intent. No liability for indirect damage, loss of profit, or consequential costs, where legally permitted.
13. Customs and Import
Customer is responsible for all import, tax, and registration regulations in the destination country. Extra costs (duties, import VAT, etc.) are borne by the customer.
14. Technical Information
All technical data is provided to the best of our knowledge. Liability for application errors or incorrect vehicle data is excluded unless confirmed in writing.
15. Jurisdiction and Law
Austrian law applies, excluding UN Sales Law (CISG). Jurisdiction is Perg, Austria, unless mandatory rules (e.g. for consumers) apply.
16. Severability Clause
If any provision is invalid, the rest remain valid. The invalid term will be replaced with one closest to its original intent.
17. Copyright and Website Content
All content on www.langwieser-performance.com – including texts, descriptions, images, logos, videos – is protected by copyright and owned by Langwieser Performance GmbH.
Use, reproduction, or publication without written consent is prohibited, especially for:
– Commercial use of texts or technical notes
– Copying images or logos
– Using our content on external shops or sites
– Using our terms or warranty texts elsewhere
Unauthorized use may result in legal action and a contractual penalty of EUR 1,500 per case. Further claims remain reserved.
18. Sale of Donor / Defective Parts
Some items are sold as defective or for parts only. These are marked accordingly and intended for parts reuse.
Sales of defective items exclude functionality guarantees. Warranty covers only conformity with description and delivery condition.
B2C: These limits apply only if the condition was clearly stated and acknowledged before purchase.
19. Non-Binding Technical Advice
We provide voluntary support via email, phone, or chat for troubleshooting and part identification. Such recommendations are non-binding and not legally guaranteed.
The customer or workshop is responsible for final verification and installation decisions.
We exclude any liability for damages, incorrect purchases, or costs resulting from misinterpreted or incomplete advice.
